- Whenever the Terms and Conditions refer to:
- Seller – refers to the person selling the Device to the Purchaser;
- Consumer – refers to a Seller who is a natural person entering into a Trade-in Agreement for purposes not directly related to their business or professional activity;
- Device – refers to a used electronic device submitted for trade-in;
- Valuation Form – refers to the form on the telefoniki.pl website in which the Seller describes the Device;
- Preliminary Valuation – refers to the amount quoted to the Seller based on data from the Valuation Form, prior to inspection of the Device;
- Final Valuation – refers to the amount the Purchaser offers to pay after inspecting the Device;
- Trade-in Agreement – refers to the contract for the sale of the Device in which the Purchaser is the buyer and the Seller is the seller;
- Business Day – refers to any day from Monday to Friday, excluding statutory public holidays;
- Store Terms and Conditions – refers to the terms and conditions of the telefoniki.pl store and website.
- The Terms and Conditions are available free of charge on the website in a way that allows them to be downloaded and saved. The Seller accepts them before submitting the Valuation Form or before concluding the Trade-in Agreement at the stationary service point.
- Neither the submission of the Valuation Form nor the handover of the Device obligates either party to conclude a Trade-in Agreement. The Trade-in Agreement is concluded solely under the conditions set out in §6.
- The use of the Valuation Form as an electronically supplied service, including technical requirements and complaints regarding this service, is subject to §§3–4 of the Store Terms and Conditions.
§2. Who may sell and which devices we accept
- The Seller may be a natural person of legal age with full capacity for legal acts or a business entity acting through an authorized person. The Purchaser does not buy devices from minors.
- A Seller who is an active VAT payer and who sells a Device as part of their business activity shall issue an invoice to the Purchaser. The terms of settlement for such a sale shall be agreed upon by the parties before the conclusion of the Trade-in Agreement.
- The Purchaser buys Devices indicated in the Valuation Form (currently iPhone phones). Other devices may be purchased upon individual agreement.
- The Purchaser does not buy Devices:
- reported as lost or stolen or with a blocked IMEI number;
- with an active activation lock or linked to an account (e.g., Apple ID, Google account) that the Seller does not remove;
- subject to mobile device management (MDM), e.g., company devices that have not been released by the employer;
- counterfeit, with a removed, altered, or illegible IMEI or serial number;
- that are subject to leasing, rental, pledge, attachment, or retention of title in favor of another person;
- for which there is a reasonable suspicion that they originate from a crime.
- Installments and operator contracts. The Seller shall inform in the Valuation Form whether the Device was purchased on installments or as part of an operator contract and whether the payments have been settled. Unpaid installments may result in the Device being blocked by the operator. The Purchaser may refuse to purchase such a Device or take this risk into account in the Final Valuation.
§3. Seller's declarations
- By submitting the Valuation Form and subsequently accepting the Final Valuation, the Seller declares that:
- they are the owner of the Device or are authorized to sell it on behalf of the owner;
- the Device does not originate from theft, fraud, or any other prohibited act and has not been reported as lost;
- the Device is not encumbered by the rights of third parties (e.g., leasing, pledge, attachment, retention of title), except for those disclosed in the Valuation Form;
- the information in the Valuation Form is true and complete, particularly regarding the model, memory, condition, defects, prior repairs, replaced parts, and contact with liquid;
- they have disclosed the status of installments or obligations toward the operator related to the Device;
- before handing over the Device, they will remove the activation lock and linked accounts and data, in accordance with §8.
- The Purchaser may request proof of purchase of the Device or another document confirming its origin. Lack of such a document does not exclude trade-in but may be grounds for refusal if the origin of the Device raises doubts.
- If it turns out that the Seller's declarations were untrue, the Purchaser may refuse to conclude the Trade-in Agreement, and after its conclusion, exercise the rights under §9. In case of a reasonable suspicion of a crime, the Purchaser shall notify law enforcement agencies.
§4. Preliminary valuation and handover of the Device
- In the Valuation Form, the Seller selects the model and memory of the Device, describes its condition according to the criteria provided in the form, and provides contact details.
- The Preliminary Valuation is an estimate based solely on data provided by the Seller. It is not an offer within the meaning of Art. 66 of the Civil Code. The Purchaser maintains it for 7 days, provided that the Device is delivered or shipped during this time and its condition matches the description in the Valuation Form.
- The Device can be:
- delivered in person to the address in §1(2);
- shipped using a label provided free of charge by the Purchaser;
- shipped via the Seller's own carrier, at the Seller's cost and risk, after prior contact with the Purchaser.
- The Seller shall pack the Device so that it is not damaged during transport, without a SIM card or memory card. Only items indicated in the Valuation Form (e.g., box, charger) should be included in the package. Devices with a swollen or damaged battery must not be shipped via carrier.
- If a shipment sent with the Purchaser's label is lost or damaged in transit, the Purchaser shall conduct a complaint procedure with the carrier and transfer any compensation obtained to the Seller.
§5. Device verification and Final Valuation
- The Purchaser shall inspect the Device within 3 Business Days of receipt. Verification includes in particular: model and memory consistency, IMEI or serial number in available databases of lost and blocked devices, activation and MDM locks, operator lock, function testing, visual condition, battery health, history and originality of parts, and signs of liquid contact and prior repairs.
- The Purchaser does not open the Device without the Seller's consent. The Purchaser documents the unpacking of the shipment and any identified defects with photos or recordings and makes them available to the Seller upon request.
- If the condition of the Device corresponds to the description in the Valuation Form and the Device was delivered within the time limit set in §4(2), the Final Valuation is equal to the Preliminary Valuation.
- If the condition of the Device differs from the description, the Purchaser shall present a Final Valuation for a different amount, together with justification and the documentation mentioned in paragraph 2.
- The Purchaser shall provide the Final Valuation via e-mail or SMS. It is valid for 5 Business Days. The Seller may accept or reject it. Lack of response within this period means the Final Valuation is rejected, not accepted.
- The Purchaser may refuse to purchase the Device if a case under §2(4) occurs or if the Device is not suitable for trade-in. In such cases, §7 applies.
§6. Conclusion of the Trade-in Agreement, transfer of ownership, and payment
- The Trade-in Agreement is concluded at the moment the Seller accepts the Final Valuation within its validity period, from the e-mail address or phone number provided in the Valuation Form. At a stationary service point, the Trade-in Agreement is concluded at the moment the contract is signed or the trade-in is confirmed.
- The Purchaser shall send the Seller confirmation of the conclusion of the Trade-in Agreement via e-mail on a durable medium. The confirmation includes the parties' data, a description of the Device with the IMEI or serial number, the price, and the date of the agreement.
- Upon conclusion of the Trade-in Agreement, ownership of the Device transfers to the Purchaser.
- The Purchaser shall pay the price within 7 Business Days of the conclusion of the Trade-in Agreement: by transfer to the Seller's bank account, in cash at a stationary service point, or, if the Seller chooses, in the form of a voucher for purchases at the telefoniki.pl store.
- The transfer is made only to an account held by the Seller. The Purchaser may refuse payment to a third party's account.
- Before payment, the Purchaser may verify the Seller's identity: at a stationary service point – by presentation of an identity document, and remotely – by comparing the Seller's data with the account holder's data. The Purchaser does not make copies of identity documents without the Seller's consent.
- Voucher. The voucher has a value equal to the trade-in price increased by 100 PLN, is valid for 12 months, cannot be exchanged for cash, and can be used for one or more orders. The choice of a voucher is voluntary. In the event of withdrawal from a sales contract for goods purchased with a voucher, the voucher value is restored.
§7. Return of the Device when a Trade-in Agreement is not concluded
- If the Seller rejects the Final Valuation, does not respond to it within the deadline, or the Purchaser refuses the purchase, the Purchaser shall return the Device within 3 Business Days: by sending it to the address provided by the Seller or releasing it at a stationary service point. The Device is returned in the condition in which it was received.
- Return of the Device is free of charge for the Seller.
- If the Device cannot be returned for reasons attributable to the Seller (e.g., uncollected shipment, lack of contact), the provisions of §15(4)–(8) of the Store Terms and Conditions regarding uncollected devices shall apply accordingly.
- If the Purchaser has notified law enforcement agencies of a suspicion that the Device originates from a crime, they shall act in accordance with the decision of those authorities and may withhold the return until such a decision is issued.
§8. Data on the Device
- Before handing over the Device, the Seller should: back up necessary data, log out of all accounts (e.g., Apple ID, iCloud), turn off the "Find My" function and activation lock, disconnect paired devices (e.g., Apple Watch), remove the device from the list of trusted devices on the account, and restore factory settings.
- After the conclusion of the Trade-in Agreement, the Purchaser shall permanently delete all data from the Device using the method provided by the manufacturer before its further sale or repair. The Purchaser does not view or copy the content left on the Device.
- The Purchaser is liable for damages related to data left on the Device only if they were caused by the Purchaser's fault. Failure by the Seller to fulfill the obligations in paragraph 1 shall be taken into account when determining liability (Art. 362 of the Civil Code).
- If the Device is returned to the Seller under §7, the Purchaser shall not delete data from it without the Seller's consent.
§9. Seller's liability for legal defects and locks
- Since the Purchaser inspects the Device before the conclusion of the Trade-in Agreement, the Seller is not liable for physical defects of the Device, except for defects they fraudulently concealed (e.g., hidden traces of liquid damage or repairs of which they were aware).
- The Seller is liable to the Purchaser for legal defects of the Device under the principles of the Civil Code, particularly if the Device is the property of a third party, is encumbered by a third party's right, or originates from a crime.
- If, after the conclusion of the Trade-in Agreement, the Device is blocked by the operator or manufacturer or seized by law enforcement authorities due to reasons existing before the sale (e.g., unpaid installments, theft report, revealed activation lock), the Purchaser may withdraw from the Trade-in Agreement and demand a refund of the paid price, as well as compensation for damage on general principles. If the Device remains in the possession of the Purchaser, it shall be returned to the Seller upon receipt of the refund.
- The Seller bears liability for damage caused to the Purchaser by submitting knowingly false declarations under §3.
§10. Withdrawal from the agreement, complaints, and disputes
- If a Consumer who has concluded a Trade-in Agreement remotely is entitled to a right of withdrawal under applicable regulations, they may exercise this right within 14 days of concluding the Trade-in Agreement by submitting a declaration to the address kontakt@telefoniki.pl or in writing. In such a case, the Consumer returns the received price (or if a voucher was chosen – the voucher loses its validity for the unused portion, and the Consumer returns the used portion in cash), and the Purchaser returns the Device immediately, no later than 14 days after receiving the refund of the price. This right does not apply to a Trade-in Agreement concluded at a stationary service point.
- Complaints regarding the trade-in can be submitted via e-mail to kontakt@telefoniki.pl or in writing to the address in §1(2), providing contact details, the application number, and a description of the issue. The Purchaser shall respond within 14 days of receiving the complaint.
- The Consumer may use extrajudicial means of resolving disputes under the rules of §19 of the Store Terms and Conditions.
- Disputes with Consumers shall be resolved by courts competent in accordance with the Code of Civil Procedure, and disputes with businesses – by the court competent for the Purchaser's registered office.
§11. Personal data, taxes, and final provisions
- The administrator of the Seller's personal data is the Purchaser. The Purchaser processes: identification and contact data, bank account number, Device data (including IMEI or serial number), and, during verification at a stationary service point, the type and number of the presented identity document.
- Data is processed for the following purposes: conclusion and performance of the Trade-in Agreement (Art. 6(1)(b) GDPR), fulfillment of tax and accounting obligations (Art. 6(1)(c) GDPR), and verification of the legal origin of Devices, prevention of abuse, and pursuing or defending against claims (Art. 6(1)(f) GDPR). Data is stored for the period required by tax and accounting regulations and until the expiry of the limitation period for claims. Other information, including information about the Seller's rights, is contained in the Privacy Policy.
- The trade-in price is the final amount. The Purchaser does not deduct taxes from it. Any tax on civil law transactions resulting from the Trade-in Agreement shall be paid by the Purchaser.
- A Seller who is a natural person and who does not sell the Device as part of business activity declares in the Valuation Form or in the agreement that they are not acting as a VAT payer in this transaction.
- The applicable law is Polish law. No provision of the Terms and Conditions limits the rights of a Consumer resulting from mandatory provisions of law.
- The Purchaser may change the Terms and Conditions for important reasons, in particular due to changes in regulations, the scope of devices purchased, or the method of trade-in implementation. For applications submitted before the change, the Terms and Conditions as of the date of sending the Valuation Form apply.
- In matters not regulated, the Store Terms and Conditions and the provisions of the Civil Code apply.
- The Terms and Conditions are effective as of October 8, 2026.
